The article emphasizes the relevance of researching issues of criminal liability for domestic violence. It highlights the danger of this act, which not only harms a person’s health but also damages family relationships, which are the basis for the development of modern society and the state. Moreover, the victims of this offense are the most vulnerable categories of people: children, older people, etc. Emphasis is also placed on the fact that, for a long time, domestic violence was hidden and society tried not to notice it, which contributes to its high latency even today. It is determined that establishing criminal liability for domestic violence is in line with current trends in the development of criminal law and international standards for combating this type of offense. Definitions of domestic violence in international legal acts and national legislation, including criminal law, are provided. It should be noted that the definition of domestic violence set out in the current Criminal Code of Ukraine is not ideal and raises several questions from academics and causes problems in law enforcement. One of the most pressing and problematic issues in defining domestic violence is the criterion of its systematic nature, which is provided for in Article 126-1 of the Criminal Code of Ukraine. A list of questions that need to be answered when revealing the systematic nature of domestic violence is provided. The positions of scholars on defining the concept of systematicity and its characteristics are analyzed. The position of law enforcement officials on the understanding of systematicity as a sign of domestic violence is presented. Conclusions are drawn on the need to improve the current legislation by adopting a note to Article 126-1 of the Criminal Code of Ukraine, which would clarify the meaning of systematicity as a sign of domestic violence.
