This article emphasizes the importance of considering general sentencing principles in the law enforcement process. It underlines that mitigating circumstances are an integral part of the general principles of sentencing, and their consideration is a crucial element in the mechanism for implementing the principle of individualized punishment. It is determined that over the last decade, there has been a rapid increase in the number of military criminal offenses for which courts have imposed criminal penalties. Conditional stages are identified during which there was an increase in the number of criminal offenses committed under Article 402 of the Criminal Code of Ukraine, “Disobedience.” Statistical indicators of the number of such crimes from 2013 to 2022 are provided. It is determined that to study the practice of sentencing and considering mitigating circumstances in the process of such activity, it is necessary to analyse a representative number of court judgments that have entered into legal force. Thus, the basis for analyzing the peculiarities of considering mitigating circumstances when punishing for committing an act provided for in Article 402 of the Criminal Code of Ukraine was 100 court judgments handed down between 2014 and 2025. It was found that in most cases, mitigating circumstances were not considered when punishing for committing an act provided for in Article 402 of the Criminal Code of Ukraine. The most frequently considered circumstance was sincere repentance. Additionally, it was established that other circumstances were rarely taken into consideration. At the same time, the peculiarities of their consideration when imposing punishment were studied.
