The article analyzes the mitigating and aggravating circumstances as elements of the general principles of sentencing provided for by the current Criminal Code of Ukraine. The author determines the importance of considering mitigating and aggravating circumstances for the sentencing process. The author notes a lack of scientific research into the practice of sentencing for an act under Parts 1 and 2 of Article 270 of the Criminal Code of Ukraine. The author emphasizes that, given the limited representativeness of such a study, there is nevertheless a particular possibility of building an algorithm for considering the general principles of sentencing for an act under Article 270 of the Criminal Code of Ukraine and mitigating and aggravating circumstances. The author emphasizes the importance of considering mitigating and aggravating circumstances for implementing the principle of differentiation and individualizing punishment. The analysis of the practice of sentencing for an act under Article 270 of the Criminal Code of Ukraine has shown that the court’s palette of mitigating circumstances considered when sentencing for this criminal offense is somewhat limited. The author defines the range of the most typical circumstances that the court considers when sentencing for an act under Article 270 of the Criminal Code of Ukraine. It is stated that such circumstances lead to the application of other criminal law institutions, for example, the imposition of a lighter sentence than that provided by law. It is noted that among the verdicts studied, many do not contain mitigating or aggravating circumstances. The author notes that there is almost a complete absence of aggravating circumstances when sentencing for an act under Article 270 of the Criminal Code of Ukraine.
