The article analyzes the issue of sentencing for theft combined with breaking into a dwelling, other premises, or a storage facility. It highlights the peculiarities of punishing for committing such an offense under martial law. The study is based on the works of contemporary scholars in criminal law who have researched this issue, and on law enforcement practice, sourced from the Unified State Register of Court Decisions. It is noted that the open aggression against Ukraine has given rise to complex challenges and a response from the legislator, who has introduced several amendments to the current Criminal Code aimed at strengthening criminal liability for criminal offenses against property. The article presents the opinion of scholars that the mere act of committing theft in the presence of a declared martial law requires qualification of the act under Part 4 of Article 185 of the Criminal Code of Ukraine. When theft is committed in conjunction with breaking into a dwelling, other premises, or a storage facility, punishment is automatically imposed for a combination of criminal offenses, since, in the presence of a declared state of war, each theft is considered to have been committed in the presence of aggravating circumstances. At the same time, despite this conclusion, supported by many scholars, an analysis of sentencing practices reveals another approach. In some court rulings imposing punishment for theft combined with breaking into a dwelling, other storage facility, or premises, the act is not classified as theft committed under martial law. Moreover, this situation is observed in rulings issued several years after the relevant changes were introduced. However, in most cases, the algorithm for punishing Articles 185, parts 3 and 4, of the Criminal Code of Ukraine is observed.
