Legal mechanisms for the management of tourism activities in the regional context

Under current conditions, tourism is acquiring strategic importance for the socio-economic development of Ukraine’s regions. It contributes to job creation, infrastructure growth, cultural heritage preservation, and forming a positive territorial image. At the same time, the effectiveness of tourism activities largely depends on a coherent and well-aligned legal framework regulating the activities of tourism sector stakeholders. In practice, legislation remains fragmented, powers between government levels are poorly delineated, and there is a lack of a systematic approach to coordination and digital support for tourism policy. This diminishes governance efficiency, hinders investment activity, and slows the implementation of sustainable development strategies. The study aims to analyze the legal mechanisms of tourism governance at the regional level in Ukraine and develop proposals for their improvement. The research focuses on the role of legal regulation, information and digital tools, institutional interaction, and public-private partnership practices. Special emphasis is placed on harmonizing national and local legislation to enhance decision-making effectiveness and strengthen regional competitiveness in the tourism sector. The research materials include: (1) current legislation and regulations governing tourism activities in Ukraine, particularly laws defining the powers of authorities, requirements for tourism sector actors, and mechanisms of state support; (2) analytical reports of central and regional executive bodies; and (3) academic works by Ukrainian and foreign scholars on legal regulation, decentralization, public-private partnerships, and tourism development in transitional contexts. The study applies systematic, dialectical, and comparative-legal approaches to assessing the existing legal mechanisms, identify regulatory gaps and contradictions, and develop substantiated proposals for improving tourism governance at the regional level. The article reveals that the legal mechanisms of tourism governance in Ukraine are fragmented, complicating coordination between government bodies and reducing the effectiveness of regional tourism policy. Current legislation fails to delineate powers between central and local authorities, resulting in duplication of functions or regulatory gaps. Particular attention is paid to digital and information tools, often underdeveloped or absent from many regions. The potential of cluster approaches and public-private partnerships is identified as key to improving management effectiveness. The study substantiates the need for unified approaches to strategic tourism planning at the local level, considering security, economic, and digital challenges. Future research should focus on developing model frameworks for legal regulation tailored to communities with varying tourism potential and adapting best European practices in tourism management under decentralization and digital transformation conditions.
