European justice standards and challenges in their implementation in Ukraine

The article examines the essence, content, and significance of European standards of justice, as well as the challenges that arise during their implementation and practical application in Ukraine under current conditions, particularly during martial law. It is noted that European standards of judicial proceedings are a set of principles, norms, and requirements enshrined in international legal acts of the Council of Europe and the European Union, the practice of the European Court of Human Rights and the Court of Justice of the European Union, which define the fundamental principles of the administration of justice, covering guarantees of the right to a fair trial, access to justice, and the enforceability of court decisions. European standards of judicial proceedings are general in nature and establish minimum requirements for judicial proceedings, aligning with international principles of justice and contributing to the harmonization of national judicial systems. European standards of judicial proceedings are implemented through their incorporation into national legislation and practice, have constitutional grounds for application in Ukraine, and are notable for their adaptability to modern conditions. Particular attention is paid to analyzing the problems that have arisen in the Ukrainian judicial system because of the full-scale armed aggression of the Russian Federation. It is noted that, in today’s highly challenging conditions, the Ukrainian judicial system demonstrates a high capacity for adaptation, introducing new organizational and legal mechanisms, modernizing case review procedures, and actively utilizing modern technologies to ensure the continuity of justice. Such measures not only allow the judiciary to continue functioning in wartime but also bring Ukrainian judicial practice closer to European standards. The author substantiates the need for further scientific research in this area to develop effective mechanisms for adapting the judicial system to modern challenges and ensuring full compliance with international standards in national practice.
