Economic and legal support of enterprise sanation as a system for preserving the potential for solvency recovery

This article examines the economic and legal framework for corporate reorganization as a system for preserving the potential to restore solvency in a crisis environment and amid growing risks in economic activity. The relevance of the study stems from the intensifying impact of military, economic, and institutional challenges on enterprise operations, necessitating a reevaluation of traditional approaches to corporate restructuring and crisis management. It is argued that modern reorganization should be viewed not as the final stage of responding to a financial crisis or a component of bankruptcy proceedings, but as a system of preventive economic and legal mechanisms aimed at maintaining the enterprise’s viability and preventing it from losing opportunities for financial recovery. An approach is proposed in which the central object of analysis is the potential for restoring the enterprise’s solvency, encompassing the resource, operational, debt, managerial, and institutional prerequisites for the successful implementation of rehabilitation measures. It is demonstrated that the economic and legal framework for rehabilitation should be understood as an integrated system comprising economic conditions, institutional and legal decisions, and organizational mechanisms that ensure an enterprise’s viability at the stage of imminent insolvency. The main functions of such a system have been identified, including diagnostic, stabilization, restructuring, protective, coordination, and temporal functions, and their role in ensuring a timely anti-crisis response has been substantiated. The structural components of the economic and legal framework for rehabilitation have been systematized, including informational-diagnostic, debt-restructuring, active-protective, operational-continuity, organizational-coordination, and temporal-procedural components. It has been established that their coordinated functioning creates the prerequisites for preserving the enterprise’s operational potential, protecting assets, stabilizing cash flows, and increasing the effectiveness of restructuring processes. Attention is paid to the importance of mechanisms for early warning of crises, preventive restructuring, and internal anti-crisis monitoring systems, which enable the timely detection of signs of financial destabilization and prevent the enterprise from sliding into irreversible insolvency.
