Convergence of civil and labour law in the area of contractual regulation of relations in which a person exercises the right to work

The digitalization of the economy has led to the emergence of new forms of labor organization in society, which require different approaches to legal regulation. Since the contract is a central institution of both labor and civil law and the primary means of formalizing relationships where a person exercises their right to work, these tasks can be addressed using the existing tools of civil law. This convergence of civil and labor law processes the alignment of labor and civil law. The article analyzes the main directions of this convergence in the contractual regulation of the right to work and its impact on protecting the parties’ rights. The author concludes that the convergence of civil and labor legislation has several positive outcomes for civil and labor law. However, the influence of civil law on labor relations regulation is more significant than the influence of labor law on civil law. Therefore, the article focuses on the main directions of expanding civil law’s influence on labor relations. Firstly, the scope of dispositive regulation in labor law has significantly expanded, especially in the contractual regulation of labor relations. As a result, the labor contract, as a vital tool for exercising the freedom of will of the parties, has become more flexible and better adapted to meet the interests and needs of each party. Secondly, the convergence of civil and labor law has also allowed for the subsidiary application of civil law to labor relations when labor law norms do not regulate them. Thus, the tools of civil law protect the rights and interests of labor law subjects. Thirdly, due to the convergence of civil and labor law, complex contracts contain elements of civil and labor contracts, such as gig contracts. These contracts can more flexibly meet the parties’ specific requirements, using the legal tools of each field of law to which their elements belong.
